Former Savannah police officer Ernest Ferguson’s defense files motion to dismiss murder case

SAVANNAH, Ga. (WTOC) - Former Savannah police officer Ernest Ferguson, who faces felony murder charges from the shooting death of 31-year-old Saudi Lee was in court Tuesday.

A motion to dismiss Ferguson’s case was filed due to what the defense called misconduct by the prosecution.

They argued that the state didn’t provide information to the defense regarding the grand jury for the trial, and that improperly using bad character evidence influenced the jury in an unfair and unjust way.

The defense says Ferguson was challenged, ridiculed, and improperly badgered by the state during cross-examination, and wasn’t provided rebuttal evidence to Ferguson’s testimony without him being present, which prevented him from explaining or refuting that evidence during his cross-examination.

The state countered Tuesday by saying that they were not entitled to provide information or rebuttal evidence to Ferguson.

The judge did not make a decision Tuesday but Ferguson will be back in court this Friday.
